Browsing the website www.bailarines.ro followed by the Order is equivalent to reading, understanding and accepting the terms below by any Customer.

www.bailarines.ro reserves the right to change and update at any time the content of this website, as well as the Terms and conditions of use, without any prior notification.

In case of divergence or misunderstandings between www.bailarines.ro and the Client, the Terms and Conditions valid at the time of the Order will apply.

1. Definitions

User – any person who visits the website www.bailarines.ro.

Customer – natural person / legal person who places an Order.

Products and Services – any product or service mentioned in the Order, to be provided by the Seller to the Customer.

Order – an electronic document that intervenes as a form of communication between the Seller and the Client through which the Client expresses his intention to purchase certain Products and Services and make their payment.

Seller – the company SOUTH CEM SRL-D, having the following identification data: Unique Registration Code 37213334, registered at the Trade Registry with no. J13/617/2017 and with the address in Str. Stefan Cel Mare, No. 79, Room No. 1, Sc. B, Floor 4, Ap. 24, Constanta, Jud. Constant.

Contract – an Order confirmed by the Seller, by which the Seller agrees to sell and deliver the Products and Services and the Customer agrees to purchase, receive and pay for these Products and Services.

Courier – any person under public or private law that provides express courier services.

2. Intellectual property rights

The content of the www.bailarines.ro website: images, texts, web graphic elements, scripts, software, design rights, model rights, patents, registered trademarks, is fully the property of www.bailarines.ro and its suppliers and is apparatus of the Law on copyright and related rights and the laws on intellectual and industrial property. The use without the consent of www.bailarines.ro of any elements listed above is punishable according to the legislation in force.

www.bailarines.ro can offer the User/Client, through an agreement, the right to use, in a described form, certain content of the site. This agreement applies strictly to the content/contents defined, for a period established in the agreement and only for the person/persons who were allowed to use these contents, without being able to use other contents of the website www.bailarines.ro.

The use of any registered brand name on www.bailarines.ro does not constitute advertising for the respective company. www.bailarines.ro does not assume responsibility and cannot be blamed for damages caused by using the site’s content.

3. Exoneration from liability

www.bailarines.ro does not guarantee that the site, the servers on which it is hosted, or the e-mails sent from www.bailarines.ro are free of viruses or other potentially harmful computer components, that they do not contain errors, omissions, defects , delays or interruptions in operation or transmission, line failures or any other similar factors. The user uses the site at his own risk, www.bailarines.ro being free from any liability for any direct or indirect damages caused by using or accessing/visiting the site or as a result of using the information on the site. www.bailarines.ro is not responsible for errors or omissions that may occur in the drafting or presentation of materials on the site.

The information included on www.bailarines.ro is informative and is made available in good faith, from sources that the Seller considers reliable. In the event that any of the published articles or any other information falls under the scope of the Law on copyright and related rights, the User is requested to bring this fact to the attention of the Seller at contact@bailarines.ro, so that the necessary legal measures can be taken .

The opinions expressed in the materials that are published in the reviews section are fully assumed by the authors of the respective materials and do not imply the joint responsibility of www.bailarines.ro.

www.bailarines.ro reserves the right to cancel Orders for Products and Services that are displayed on the site as a result of technical errors, or that, due to technical errors, present obviously erroneous/derisive prices for products (prices that can any buyer with an average level of training considers them to be erroneous/derisory).

www.bailarines.ro, as the organizer of promotional campaigns, does not assume responsibility for the loss or damage of the campaign voucher, is not responsible for forged or damaged vouchers and reserves the right to cancel the voucher used for purchase or to reduce its value from the amount to be reimbursed, in the case of the return according to the law, of a product participating in the respective campaign.

4. Limit access to the site

The users of the website www.bailarines.ro can make comments and any other communications, they can send suggestions, questions or information, if their language is civilized, and the content of the communications is not illegal, obscene, threatening, defamatory, does not disturb in any way like other people’s private lives, does not violate intellectual property rights, does not contain viruses, does not serve promotional campaigns unrelated to www.bailarines.ro, is not mass e-mail or any other form of spam. Persons who will use a false e-mail address or send electronic messages or any other communications in the name of another natural or legal person or in the name of any other entity will be reported to the competent bodies.

In the case of sending or displaying materials/documents involving texts, replies, reviews, etc., formulated by Users, it is considered that the respective User guarantees their originality and grants www.bailarines.ro and its affiliates/associates the non-exclusive, unlimited, free, irrevocable right and retransmissible to use, reproduce, modify, adapt, publish, translate, create derivative works, as well as the right to distribute, to present these contents anywhere in the world, by any means. The user guarantees that he has all the rights to the content that he displays or transmits on the site, by any means, so that, by using this content, he does not cause damage to any third-party physical or legal entity.

5. Processing of personal data

The categories of personal data processed are: name and surname, gender, date and place of birth, data from civil status documents, telephone/fax, address (domicile/residence), e-mail, profession, place of work, professional training, situation family, economic-financial situation, data on owned assets, habits/preferences/behavior, image, voice, geolocation data/traffic data.

When a User creates an account on www.bailarines.ro, he will receive commercial communications from www.bailarines.ro only to the extent that he has given his express consent, selecting the appropriate option.

The data collected regarding newsletters and alerts are confidential. www.bailarines.ro will be able to select the Users to whom it will send newsletters and alerts.

According to Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free movement of such data, amended and supplemented, and Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector, www.bailarines.ro has the obligation to process in safe conditions and only for the specified purposes the personal data provided by the Users.

The purpose of collecting personal data is: economic-financial management, advertisement, marketing, advertising, statistics, electronic communication services, informing Customers regarding the status of their account on www.bailarines.ro, informing Customers regarding the evolution and status of Orders.

The completion by the Users of the forms on the site is equivalent to the unconditional acceptance that these data are included in the database of www.bailarines.ro and with the use and processing by www.bailarines.ro, their affiliates and collaborators for carrying out the activities listed above above, including but not limited to marketing, courier, payment/banking service providers.

Customers are guaranteed the rights provided by Law no. 677/2001 for the protection of individuals regarding the processing of personal data and the free movement of such data, respectively the right to information, the right to access data, the right to intervene, the right to oppose, the right not to be subject to an individual decision, the right to go to court in case of violation of his rights. Customers have the right to request the total or partial deletion of personal data. The customer can request any of the rights listed above on the basis of a written, signed and dated request submitted to the headquarters of SOUTH CEM SRL-D.

The refusal to provide this data determines the impossibility of honoring the Orders.

If the Customer modifies by using the forms on the website the personal data already delivered to www.bailarines.ro and there are Orders in progress, the Orders keep their data from the moment of placing the Order and the delivery of the products will be made taking into account the data newly modified.

www.bailarines.ro does not ask its Users by any means of communication (telephone/e-mail, etc.) for confidential information, data about bank accounts, personal passwords, etc. If the User discloses them to third parties, he bears full responsibility for his actions. Thus, in cases of disclosure of such data, the User cannot hold www.bailarines.ro responsible for any kind of damage.

6. Registration as a User

To create an account on the website www.bailarines.ro, the User is obliged to use a valid e-mail address. www.bailarines.ro can refuse the registration request in situations where it finds that it has used information inconsistent with reality or uses the services in a way inconsistent with normal usage.

7. The price

The final price paid by the Customer consists of the price of the product, expressed in lei/eur and including VAT. Delivery costs are covered by the Seller for customers in Romania for orders over 500 lei. Customers from abroad bear the full cost of delivery.

8. Order

By completing the Order, the Customer guarantees that all the data provided are real and correct, otherwise they could suffer the consequences of these errors (Order delayed, wrongly sent, etc.).

www.bailarines.ro cannot be held responsible for erroneously entered information, which may result in delivery delays. In this context, all transport charges made in order to resend the Order will be borne by the Customer.

By completing the Order, the Customer agrees that a www.bailarines.ro representative will contact him by any available means agreed by the Parties (e-mail/telephone) for personal confirmation of the Order.

(This email is only a confirmation of receipt of your order request. Your contract to purchase these products is not complete until we send you an email notifying you that the products have been shipped.)

www.bailarines.ro can refuse an Order following a prior notification addressed to the Customer, without any obligations between the parties and without a party being able to claim damages, for the following situations:

· failure / invalidation of the online transaction;

· non-acceptance by the issuing bank of the Customer’s card / the transaction;

· incomplete or incorrect Customer data;

· the Client’s activity may cause damage to the site www.bailarines.ro / partners;

· one or consecutive failed deliveries;

· other objective reasons: if the Client does not guarantee that the payment method is valid and that it is not obtained through a fraudulent method or there are suspicions regarding the payment method.

Even if it has taken all measures to ensure that the information presented on this website is accurate and correct, www.bailarines.ro cannot be held responsible for inaccuracies that may appear when the Customer completes the forms on the website to complete the Order. Users are responsible for evaluating the accuracy, completeness and usefulness of the information provided in the forms available on this site.

In certain situations and for justified reasons, www.bailarines.ro reserves the right to change the quantity of Goods and/or Services in the Order. In these situations, www.bailarines.ro will notify the Customer at the e-mail address or phone number provided to the Seller when placing the Order and will return the amount paid.

The contract is considered concluded between the Customer and www.bailarines.ro at the moment of receipt by the Customer from www.bailarines.ro, by means of electronic mail and/or SMS, of the notification of dispatch of the Order.

In the event that a Good and/or Service ordered by the Customer cannot be delivered by www.bailarines.ro, we undertake to inform the Customer of this fact and to return to the Customer’s account the consideration for the Good and/or Service, within maximum 14 days from the date on which www.bailarines.ro became aware of this fact or from the date on which the Client expressly expressed his intention to terminate the Contract.

9. Billing – payments

The price, payment method and payment term are specified in the Order. The Seller will issue an invoice to the Customer for the Products and Services delivered, the Customer’s obligation being to provide all the information necessary to issue the invoice in accordance with the legislation in force.

Payment can be made online (card) or cash on delivery.

10. Warranty

Products purchased from the online store www.bailarines.ro are guaranteed for 30 days.

In order to benefit from the guarantee, the Customer has the following obligations:

· the product was purchased from www.bailarines.ro and used only for the purpose for which it was designed;

· to respect the instructions for use and to use the product according to the instructions imposed by the manufacturer;

· to keep the fiscal document with which he bought the product;

· keep the original packaging and all the accessories that came in it, and deliver them together with the product under warranty.

The place of presentation to be able to benefit from the warranty is the one specified by the Seller, and the cost of transport is borne by the Customer. Causes of loss of warranty:

· breakdowns or mechanical damage; excessive exposure to solar radiation; missing or changing the device series; product changes;

· the failure produced as a result of non-compliance with the instructions for use, transport, handling and installation provided in the user manual;

· flooding, arson, exposure to the sun, electrical discharges, improper modifications or installations, unauthorized interventions;

www.bailarines.ro does not offer guarantees to Customers:

· if the purchased product does not meet the requirements or expectations of the Customers;

· after the expiration of the period for which the Seller offers a product guarantee;

· if the replacement of non-compliant products or components is impossible to ensure, including as a result of the lack of equipment or related technology.

All other provisions included in the legislation in force, regarding the guarantee of the products sold, are valid. Clients’ rights are those stipulated in the legislation in the field. The warranty does not extend to any damage caused by the use of the product.

11. Delivery

For all product categories, the maximum delivery time is 14 days from the date of Order confirmation. The exact date will be confirmed in the Order confirmation email or phone. For pre-orders, the delivery time can be up to several months and it is mentioned on the product page.

For Customers from abroad, the final price of the Order will be communicated by e-mail, and the delivery will be made after the explicit acceptance of this price.

For the products in stock, the delivery will be made by Courier. There is an interval of 24-48 hours between the registration of the Order and its collection by the Courier. Any additional delay will be communicated to the Client and a new delivery term will be agreed with him which will not be able to exceed the maximum term provided above.

Careful! Due to the very short processing time of the Orders, it is impossible to make changes to the Orders already placed.

If the products are unavailable (including if the price or some characteristics of the products have undergone changes after the confirmation of the Order), www.bailarines.ro will inform the Customer about the unavailability and the amounts he paid will be refunded in term of 14 days. The customer can confirm the changes made regarding the price or the characteristics of the products, thus modifying the initial Order, and www.bailarines.ro will deliver the products according to the Order thus modified.

For products that are not in stock, the Customer agrees that www.bailarines.ro will deliver a product with qualities and price equivalent to those requested. If the Customer exercises the right to unilaterally terminate the contract within 14 days of receiving the products, the costs of returning the products are borne by the Customer.

11.1 Delivery conditions

At the request of www.bailarines.ro or the Courier, the Customer will provide proof of his identity, if necessary through one or more documents issued by official authorities, and will communicate the Order number assigned by the Seller.

If the Customer is unable to receive the Order in person, the Order will be left at the specified address only to a person over the age of 18 and only if the Order number is communicated to the Courier.

No order delivery request will be honored if the Customer does not meet the above conditions.

In the case of delivery to the Customer’s place of work, in which case the Courier cannot have access to the respective location, the Customer must ensure that he can receive this Order.

The customer will be contacted by phone by the Courier in advance to obtain confirmation of his presence at the address and time selected at the time of validation of the Order on the website.

The customer undertakes to be present at the indicated delivery address, in the selected time slot, otherwise he will bear the transport fee related to a possible new delivery. The time interval can be changed later, only with the Courier’s agreement.

The delivery is considered to be fulfilled by www.bailarines.ro, at the time of delivery of the products ordered to the Customer at the address selected by him at the time of placing the Order.

11.2 Reception of the products

The customer undertakes to sign the delivery note (AWB) presented by the Courier upon delivery of the ordered products, to which is attached the fiscal invoice containing all the information about the delivered products (product name, quantity, price). Also, the Customer will check if the products are damaged or if there are any shortages, and any problems will be holographically mentioned on the delivery note, so that they can be taken into account.

By signing the delivery note, the Customer acknowledges receipt of the Ordered products in good condition and in full.

12. Promotional campaigns

12.1 Promotional codes

The promotional codes offered by www.bailarines.ro through any promotions are valid exclusively for the section mentioned in the code transmission e-mail, unless otherwise specified. Promotional codes can be used exclusively at the time of placing the Order, they cannot be used to reduce the value of the Order after it has been placed.

Only one promotional code can be used in an Order, the Order page does not allow the use of several codes in the same Order.

In the event that a promotional code was applied to an Order that could not be honored or was canceled for any reason, the Customer has the right to request the reactivation of the respective promotional code exclusively in writing, via an e-mail to the address contact@bailarines.ro, which should contain the Order id, its status, the Customer’s name and the promotional code. They are reactivated for a maximum period of 30 calendar days.

Careful! Promotions on www.bailarines.ro are not cumulative, the biggest discount applies. This is valid for any form of discount (loyalty cards, promotional codes, gift vouchers, percentage discounts on the website, etc.) as a rule, with the exception of situations where it is mentioned otherwise in the promotion. Also, in the case of the existence of percentage vouchers, the holder of such a voucher cannot benefit from the cumulative discount conferred by the application of the percentage voucher to the already existing discount within a promotion. Certain promotional campaigns cannot be combined with other discounts, promotions or loyalty actions. This is specified in the regulations of the respective campaign.

www.bailarines.ro establishes unilaterally or in collaboration with certain of its suppliers the regulations of the promotions and contests it organizes on www.bailarines.ro, these being published exclusively on the site. Promotions are applied to Orders that fully comply with the rules displayed on the website, within the validity period clearly mentioned and within the limit of available stock. www.bailarines.ro does not guarantee the availability of products in stock for the entire promotion period and may withdraw the promotion without prior notice.

12.2 Interruption of the promotional campaign

In the case of a promotional campaign organized by www.bailarines.ro, it, as the organizer, reserves the right to interrupt the promotional campaign at any time during its development, with prior information to the consumers through appropriate means of communication (display on the website).

The organizer reserves the right to modify any of the conditions established in the respective campaign regulations, during the campaign, for valid reasons, but not before notifying the public about these changes.
